Are your valuations accepted by HMRC for probate and tax purposes?
Yes. Our RICS Red Book valuations are prepared in accordance with the RICS Valuation Professional Standards and are accepted by HMRC, the District Valuer and the Probate Registry. We include full comparable evidence and a reasoned justification of the figure, which is exactly what HMRC requires. We have produced probate valuations for estates across our seven-county coverage area and are familiar with the additional requirements that arise when the District Valuer reviews a return.
Can you act as a Single Joint Expert in matrimonial proceedings?
Yes. Several of our surveyors are experienced in accepting Single Joint Expert instructions in divorce and dissolution proceedings. Acting as an SJE means we are instructed jointly by both parties, producing one impartial report rather than each side instructing their own expert, which saves costs and simplifies the process. Our reports comply with Part 25 of the Family Procedure Rules and we are comfortable giving oral evidence if the court requires it.
How quickly can you turn around a report for a court deadline?
We always ask about deadlines at the point of instruction so we can plan accordingly. For routine matters, reports are delivered within 5 working days of inspection. For urgent applications where a hearing date is approaching, we can often accommodate an expedited inspection and deliver the report within 48 to 72 hours. What is the difference between a Red Book valuation and an estate agent appraisal?
An estate agent's market appraisal is a non-regulated opinion of value, typically produced to win an instruction to sell. It carries no professional regulation and cannot be relied upon for legal, tax or court purposes. A RICS Red Book valuation is a regulated, professional valuation produced by a qualified RICS Registered Valuer in accordance with mandatory standards. It is objective, evidence based and subject to professional indemnity insurance. Courts and HMRC recognise this distinction and will not accept an agent's appraisal as a substitute.
Do you carry professional indemnity insurance?
Yes. As RICS regulated practitioners, we maintain full professional indemnity insurance at levels appropriate for the work we undertake. If your matter requires a specific level of cover, please mention this at the instruction stage and we can confirm the details in writing.
Can you provide retrospective valuations for CGT or divorce purposes?
Yes, retrospective valuations are a common instruction from solicitors. Whether you need a valuation as at the date of separation for matrimonial finances, as at the date of death for probate, or as at a historical acquisition date for capital gains tax calculations, we can produce a fully reasoned retrospective Red Book valuation. We research market conditions, comparable transactions and property indices for the relevant date and apply the same rigorous methodology as any other valuation.
